There are many considerations when protecting property, employees and covering liability exposures, especially since they are not a one-size-fits-all risk model. Working with a trusted broker on key risks to design an insurance program around those risks is critical. Property, liability, and workers' compensation policies should be uniquely crafted to protect tribal assets, while considering cultural preferences. A Tribal Workers' Compensation (TWC) program should be selected without sacrificing the ability to determine its level of coverage. Entities can avoid the fraud and abuse that's prevalent in state systems through a sovereign TWC program. There are several workers’ compensation carriers serving Indian Country, so your broker should provide multiple options to ensure you aren’t paying too much. It’s a best practice to get a new quote annually. With the upcoming October 1 renewal period, it’s worth your time to compare and save on your insurance premiums.

The low-income housing tax credit program (LIHTC Program) was created by the Tax Reform Act of 1986.  Although it is a federal program, it is administered by states and is available to real estate owners and private developers, including tribes and tribally owned entities.  However, the LIHTC Program is not always easily accessible to tribes. Since its inception, the LIHTC Program has allowed for the creation of over 3.2 million housing units nationwide, of which just over 31,000 were within Indian Country as of 2019 (just .9%).

Most tribes understand how important the enactment of their own laws and regulations is: not only does it provide a framework for dispute resolution and enforcement that is unique to a tribe’s culture and practice, but it is also an exercise of self-governance and self-determination.  In the employment context, the COVID-19 crisis has only highlighted the importance of tribal laws and regulations governing paid leave, medical testing, and medical exemption policies.
